1. Introduction
Welcome to Scarlett Construction Ltd. By engaging our services, you agree to the following Terms of Service, effective as of 27 July 2025.
2. Scope of Services
Scarlett Construction Ltd provides residential and light commercial construction services, including renovations, fit-outs, repairs, and maintenance. Each project will be governed by a written scope of work and agreement.
3. Quotations & Estimates
Estimates are based on the details available at the time and may change with site conditions or scope variations. Written quotes are valid for 30 days unless stated otherwise.
4. Contracts & Legislation
Our contracts comply with the Construction Contracts Act 2002, Building Act 2004, and Consumer Guarantees Act 1993. For residential building work over $30,000, we will provide a written contract along with the legally required disclosure and checklist documents.
5. Payments & Invoicing
Deposits may be required before starting. Progress invoices will be issued per the agreement. Payment claims will comply with the Construction Contracts Act 2002. Late payments may incur interest and collection costs.
6. Variations
Changes to the original scope must be confirmed in writing and may result in cost and timeline adjustments.
7. Cancellations
You may cancel a project before commencement in writing. If cancelled after work has started, costs to date (labour, materials, admin) will still apply.
8. Warranties
Workmanship is covered for 12 months under section 362I of the Building Act 2004. Product warranties apply to supplied materials. Warranty is void if work is altered or damaged after completion.
9. Health & Safety
We comply with the Health and Safety at Work Act 2015. Clients must inform us of known hazards and ensure safe access to the site.
10. Access & Site Conditions
Clients must ensure reasonable access during working hours. Delays from restricted access or unforeseen site issues may affect timeframes and pricing.
11. Delays & Force Majeure
We are not liable for delays caused by factors beyond our control, including weather, supplier issues, or third-party delays.
12. Limitation of Liability
Liability is limited to correcting defects or refunding the relevant portion. We are not responsible for consequential or third-party losses.
13. Photography & Promotion
We may take photos of completed work for marketing. Please notify us in writing if you do not wish for images to be used.
14. Dispute Resolution
We aim to resolve issues quickly. Payment disputes may be handled under the Construction Contracts Act 2002. Other disputes may go through mediation, the Disputes Tribunal, or MBIE’s Building Disputes Resolution Service.
15. Governing Law
These Terms are governed by the laws of New Zealand. Any legal matters will be handled through New Zealand courts.
